4. USER CONDUCT AND ANTI-AGGRESSION POLICY

4.1 Zero-Tolerance for Aggressive Behavior

  • We reserve the absolute right to immediately suspend, terminate, block, or permanently expunge your service access, account, and communication channels if we, in our sole discretion, deem your behavior, correspondence, or communication to be hostile, aggressive, harassing, threatening, abusive, defamatory, or toxic toward the Company, its staff, its operations, or its Founders (Steven J. Manning and Nathaniel C. Schooler).
  • Consequences of Termination for Conduct: If your service is suspended or terminated due to aggressive behavior, you will immediately forfeit all remaining access time without the right to appeal, and you will not be entitled to any financial compensation or refund.

This includes integration with advanced artificial intelligence and Large Language Models (LLMs), notably through our interactive Mentor Bot interface.

When you interface with our interactive modules, productivity tools, or the Mentor Bot, your queries, prompts, and session inputs are processed through cloud architectures powered by state-of-the-art language models.

  • You explicitly acknowledge that this data is securely passed to servers located physically within the United States of America (USA).

  • Current Posture: The technical pipelines utilized by MONDAY INFLUENCER® ensure that the third-party LLM providers and server environments located in the United States are currently prohibited from using your submitted content, proprietary queries, or data streams to train, fine-tune, or iterate their public foundational models. Your competitive edge and individual data inputs remain completely decoupled from public algorithmic data pools.

7. MENTOR BOT TECHNICAL OPERATIONS, CONTENT INDEXING, AND STORAGE

To provide unprecedented clarity while remaining strictly defensive of user data privacy, the Mentor Bot operates under highly structured, minimal-footprint data parameters.

7.1 Volatile Short-Term Session Cache

  • Volatile Context Retention: To maintain conversational continuity, the Mentor Bot stores your chat history strictly on a per-session basis.
  • Automated Ephemeral Deletion: This history is highly volatile and is programmed to be automatically purged and deleted after approximately six (6) conversational turns. Once this threshold is reached or the session is reset, the context is permanently erased from active memory buffers.

7.4 UX Optimization via Local Storage (localStorage)

  • To ensure an optimal, non-intrusive interface experience, the platform utilizes your browser’s local application storage.
  • The Dismissal Flag: Specifically, the platform sets a minimal localStorage flag solely to remember if a visitor has closed or dismissed the interface “nudge” or promotional notice. This prevents the system from repeatedly prompting you, preserving a clean digital workspace. No personal identifiers are tied to this flag.

8. OVERALL CONTENT RETENTION AND SYSTEM VOLATILITY

Beyond the short-term contextual caching required by the Mentor Bot (outlined in Section 7), we approach general enterprise data governance with strict systemic minimalism.

9. INTELLECTUAL PROPERTY AND PROPRIETARY MATRICES

All content compiled, orchestrated, and delivered via MONDAY INFLUENCER®—including but not limited to strategic frameworks, text, graphics, logic models, audio files, video presentations, the content libraries read via Google Drive API, and curated expert databases—is the exclusive proprietary property of Steven J. Manning and Nathaniel C. Schooler.

  • Copyright Protection: All rights are strictly reserved worldwide under international copyright treaties.
  • Limited Revocable License: Subscribed or registered users are granted a non-exclusive, non-transferable, revocable license to utilize our frameworks strictly for personal or internal organizational improvement.
  • Express Prohibitions: Scraping, republishing, reselling, feeding our content into external proprietary AI applications, or commercially distributing our materials without explicit, written, signed authorization from the Founders is strictly prohibited and will be prosecuted to the maximum extent of international civil and criminal law.

10. LIMITATION OF LIABILITY AND INDEMNIFICATION

To the maximum extent permitted by applicable law, in no event shall MONDAY INFLUENCER®, its co-founders (Steven J. Manning and Nathaniel C. Schooler), officers, directors, employees, or global experts be liable for any direct, indirect, punitive, incidental, special, or consequential damages whatsoever.

10.1 Scope of Damages

This limitation encompasses, without limitation, damages for:

  • Loss of business use, revenue, capital, corporate profits, or data.
  • Business interruption or missed operational windows.
  • The failure of any strategy to yield anticipated monetization, career promotions, or optimization milestones.

10.2 Indemnification Agreement

By utilizing our platform, you agree to indemnify, defend, and hold harmless MONDAY INFLUENCER® and its Founders from any claims, losses, liabilities, demands, or expenses (including legal fees) made against them by any third party due to, arising out of, or in connection with your misuse of the platform, your aggressive behavior, or any violation of the provisions of this Policy.

11. GOVERNING LAW AND JURISDICTIONAL INTERPRETATION

This Policy, its data processing protocols, commercial terms, and all contractual or tortious relationships arising from your usage of MONDAY INFLUENCER® shall be governed, interpreted, and construed exclusively in accordance with the laws of the jurisdiction where the primary corporate entity of the platform is formally registered, without giving effect to any principles of conflicts of law. Any legal suit, action, or proceeding arising out of or related to this Policy must be instituted exclusively in the designated courts of competent jurisdiction.
